Participant Agreement and Waiver

This Agreement represents the entire agreement between you (the 'Participant') and InFlow Tours, LLC ('InFlow Tours') concerning the purchase by you and your participation in a storm chasing expedition with InFlow Tours (the 'Tour'). For good and valuable consideration, the sufficiency of which is set forth below, the parties hereby agree to be bound by the following terms:

1. Tours

Each Tour will depart from and return to a designated 'Base City.' The Base City for each tour is listed on the tour schedule at www.inflowtours.com. Participants are charged the rate appearing on the InFlow Tours website at the time of their registration.

2. Deposit and Payment

A non-refundable Deposit of $500.00 USD per person is required to reserve a spot on a Tour. The remaining Balance is due no later than March 1, 2026. For any Participant registering after March 1, 2026, the full tour amount is due at the time of registration. All payments shall be made to InFlow Tours. An executed original or acknowledged digital copy of this Agreement must be received by InFlow Tours prior to the Tour's departure date. Participant’s submission of the Agreement and Deposit does not guarantee acceptance. In the rare event InFlow Tours cannot accept the Participant, InFlow Tours will provide a full refund of the Participant's Deposit.

3. Cancellation Policy

Although highly unlikely, InFlow Tours reserves the right to cancel or shorten a Tour due to unforeseen circumstances. If a Tour is cancelled by InFlow Tours prior to the start date, we will make every effort to accommodate the Participant on another Tour. If the Participant cannot be accommodated, InFlow Tours will refund all monies paid by the Participant, including the Deposit. If a Tour must be shortened while in progress, InFlow Tours will refund the Tour Fee on a pro-rata basis for the days missed. InFlow Tours shall not be liable for any other losses incurred by the Participant due to such cancellation or change, including but not limited to airfare, hotel accommodations, or lost wages.

4. Arrival and Departure

Participants must arrive at the Base City hotel in time to attend the mandatory orientation on their designated Arrival Date (orientation time will be provided via email). We strongly encourage arriving the day before the tour starts to account for any travel delays. Tours may depart as early as 11:00 AM on the Arrival Date and may return as late as 1:00 PM on the Departure Date. Participants are solely responsible for any charges incurred for not vacating the Base City hotel by its designated check-out time. All participants on tours operating in June or July must possess a valid passport, as chases may extend into Canada.

5. Transportation

InFlow Tours will provide all ground transportation necessary for the Tour, beginning at the departure from the Base City hotel and ending upon return to the Base City hotel. Participants are responsible for their own transportation (e.g., airport transfers) to and from the Base City hotel on their arrival and departure dates.

6. Lodging

InFlow Tours will arrange and provide for all lodging during the official tour period. The specific location of the Base City hotel will be provided to Participants no later than 30 days prior to the Tour Arrival Date.

7. Personal Expenses

InFlow Tours is not responsible for any personal expenditures. The Participant is solely responsible for all personal costs, including but not limited to meals, snacks, beverages, souvenirs, and laundry.

8. Safety Orientation

Every Participant is required to attend the mandatory safety orientation held on the morning of the first chase day. This orientation will cover the tour itinerary, safety protocols, and daily procedures.

9. Choice of Law and Venue

This Agreement shall be governed by the laws of the State of [Your State], without regard to its conflict of law principles. Any legal action arising from this agreement shall be brought in the appropriate state or federal court located in [Your County], [Your State].

10. Rules of Conduct

For the safety and comfort of all guests and staff, no alcohol, illegal drugs, smoking/vaping, firearms, explosives, or other dangerous articles are permitted in tour vehicles. Seatbelts must be worn at all times while tour vehicles are in motion. These rules are mandatory.

11. Right to Refuse or Remove Participant

InFlow Tours, at its sole discretion, may refuse to allow a Participant to continue with a Tour if that Participant is deemed unfit for travel, is a danger to themselves or others, or is causing a significant disturbance. Such Participant may be left at a reasonable location (e.g., the nearest town with services) without any liability or refund owed by InFlow Tours.

12. Acknowledgement of Payment Terms

I, the Participant, confirm that I have paid the non-refundable $500.00 Deposit. I agree to pay the remaining Balance of the Tour Fee by March 1, 2026, or I agree to pay the full tour amount if registering after this date.

13. No Guarantee of Weather

I understand that I am participating in an authentic storm chasing expedition. I understand that InFlow Tours cannot control the weather and does not guarantee that any specific weather phenomena, including tornadoes, will be sighted. I release InFlow Tours from any and all liability for my personal satisfaction with the weather events of the Tour, and I acknowledge that no refunds will be issued if a tornado is not sighted. This is superseded only by the "Supercell Promise" as outlined on the InFlow Tours website.

14. Personal Property

I agree to release InFlow Tours, its employees, officers, and assigns from any and all liability for lost, stolen, or damaged personal property that may occur during the Tour.

15. Adherence to Safety Guidelines

I agree to abide by all safety guidelines presented during the orientation and to adhere to any and all instructions given to me by the InFlow Tours guides at any point during the Tour.

16. Age Requirement

I acknowledge that I am over the age of 18. If I am not, I have had my parent or legal guardian execute the consent below.

17. ACKNOWLEDGEMENT OF INHERENT RISK

I AM AWARE THAT STORM CHASING IS AN INHERENTLY HAZARDOUS ACTIVITY. I UNDERSTAND THE RISKS INCLUDE, BUT ARE NOT LIMITED TO, DEATH OR SERIOUS BODILY INJURY ARISING FROM: TRAFFIC ACCIDENTS; DIRECT IMPACT FROM SEVERE WEATHER SUCH AS LARGE HAIL, DAMAGING WINDS, AND TORNADOES; LIGHTNING STRIKES; FLASH FLOODING; AND HAZARDS ASSOCIATED WITH TRAVELING IN REMOTE AREAS. I AM VOLUNTARILY PARTICIPATING IN THIS TOUR WITH FULL KNOWLEDGE OF THE DANGERS INVOLVED, AND I HEREBY AGREE TO ACCEPT ANY AND ALL RISKS OF INJURY OR DEATH. I FURTHERMORE ACKNOWLEDGE THAT I AM PHYSICALLY FIT TO PARTICIPATE IN THIS TOUR.

18. Release of Liability

As lawful consideration for being permitted by InFlow Tours to participate in the Tour, I hereby agree that I, my heirs, distributees, guardians, legal representatives, and assigns will not make a claim against, sue, or attach the property of InFlow Tours or its assigns for injury or damage resulting from the negligence or other acts, however caused, by any employee, agent, or contractor of InFlow Tours.

19. Full Release and Discharge

In addition, I hereby release and discharge INFLOW TOURS, its owners, employees, and assigns from all actions, claims, or demands that I, my heirs, distributees, guardians, legal representatives, or assigns now have or may in the future have for injury, damage, or death resulting from my participation in the Tour.

20. Mandatory Travel Insurance

I acknowledge and agree that it is a mandatory condition of booking to purchase and maintain adequate travel insurance for the full duration of the Tour. This policy must, at a minimum, cover trip cancellation/interruption and emergency medical evacuation. I agree to provide proof of such insurance to InFlow Tours upon request.

21. Final Acknowledgement

I HAVE CAREFULLY READ THIS ENTIRE AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A BINDING CONTRACT BETWEEN MYSELF AND INFLOW TOURS, AND I HAVE AGREED TO IT OF MY OWN FREE WILL.

IF PARTICIPANT IS UNDER 18 YEARS OF AGE

I, as the natural parent and/or legal guardian of the minor person executing the above-referenced release, do hereby consent to said minor person's execution of same and do hereby agree to be personally bound by all the terms and conditions set forth therein.
